Acceptance
These Terms of Use are a legal agreement between you and MTIVI LLC (“MTIVI”, “we”, “us”). By downloading, installing, or using mtivi and our services, and by creating an account, you agree to these Terms and to all of our policies. If you do not agree, do not use our Services.
The Service
mtivi is a media player. It does not provide, host, or distribute any channels, movies or series, or playlists, and does not grant access to any media. To use it, you must add your own source. Any purchase or subscription unlocks application features only.
Your responsibility
You are solely responsible for the sources and materials you add and use, for having the necessary rights to access them, and for complying with all applicable laws. You will not use our Services to infringe the rights of others or for any unlawful purpose.
Acceptable use and misuse
You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely and fully responsible for the way you use the Services and for anything you access, add, share, or do through them. mtivi is a neutral tool, and we do not monitor or control how the Services are used.
To the maximum extent permitted by law, we are not responsible or liable for any misuse of the Services, whether by you, other users, referrers, affiliates, partners, or any other third party.
No endorsement of third-party sources
We do not host, provide, control, or endorse any third-party source, and we have no relationship with the providers of anything you add.
License
We grant you a personal, limited, non-transferable, revocable license to use the app on devices you own or control. You may not redistribute, resell, modify, reverse-engineer, or attempt to extract the source code of the app.
Intellectual property and trademarks
mtivi, the mtivi logo, and all related names, designs, and branding are trademarks of MTIVI LLC, whether or not registered. All content, software, and materials we provide are protected by intellectual property laws and remain the property of MTIVI LLC or its licensors. You may not copy, imitate, modify, distribute, or use our name, logo, branding, or materials without our prior written permission, and you may not use them to impersonate us, to suggest a partnership, sponsorship, or endorsement that does not exist, or to sell or promote any product or service. Unauthorized use may constitute trademark infringement, unfair competition, and other violations of law, and may result in legal action, including injunctive relief and monetary damages.
Purchases and subscriptions
We may offer paid plans and auto-renewing subscriptions. Subscriptions renew automatically until cancelled. Available plans and prices are shown at the point of purchase. Refunds and cancellations are governed by our Refund Policy.
Referral program
We may offer a referral program that lets you invite others to mtivi and earn promotional credit. Any credit, reward, or benefit earned through the program is promotional only, has no cash value, is non-transferable, and cannot be exchanged, sold, or redeemed for money. We may change, limit, suspend, or discontinue the program at any time, and we may withhold, adjust, or revoke rewards, including where we determine in our discretion that participation involved fraud, abuse, automated activity, self-referral, or any breach of these Terms or applicable law.
You are responsible for the way you share your referral link and for complying with all applicable laws when you do. We are not responsible or liable for how you or any other participant promotes, shares, or describes mtivi or our Services.
Affiliate program
We may offer an affiliate or partner program. Participation is subject to our approval and to any additional program terms we make available. Affiliates and partners are independent and are not our agents, employees, or representatives, and nothing they say or do is authorized by, or binding on, us. You agree to promote the Services lawfully and honestly, without spam, misrepresentation, misleading claims, or any activity that could harm our reputation.
We are not responsible or liable for the conduct, statements, promotions, methods, or channels of any affiliate, partner, or referrer, or for any loss or harm arising from them. We may withhold, adjust, reverse, or cancel any commission or benefit, and may suspend or end participation, at any time, including for fraud, abuse, or any breach of these Terms, our program terms, or applicable law. Commissions and benefits have no cash value except as expressly stated in the applicable program terms.
Commissions apply only to a qualifying first purchase by a new customer, are one-time, and do not recur on renewals or later purchases. The current commission rate and any additional conditions are set out in the applicable program terms.
No warranty
The Services are provided “as is” and “as available” without warranty of any kind. We do not guarantee that any source or feature will work, or that the Services will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any damages arising from your use of the Services or from anything delivered by your sources. Nothing excludes or limits liability that cannot be excluded or limited by law.
Indemnification
To the maximum extent permitted by law, you agree to reimburse us for costs and damages arising from your use of the Services, your sources, or your breach of these Terms.
Dispute resolution
Most issues can be resolved by contacting support@mtivi.app. To the fullest extent permitted by the law of your country of residence, disputes will be resolved through final and binding individual arbitration, and you and MTIVI LLC waive any right to a jury trial or to participate in a class or representative action. You may bring an individual claim in small-claims court, and either party may seek injunctive relief to protect its intellectual property. Where mandatory local consumer-protection law prohibits this, it does not apply to you.
Governing law
These Terms are governed by the laws applicable at MTIVI LLC’s place of establishment. If you are a consumer, you keep the protection of the mandatory laws of your country of residence.
Termination
You may stop using our Services at any time. We may suspend or end your access if you breach these Terms. Provisions that by their nature should survive termination continue to apply.
Changes
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
